How an Offer in Compromise Works

There are several different types of Offers in Compromise:

  • Doubt as to collectability: This is where it can be demonstrated that there is sufficient doubt that the tax owed could be paid.
  • Doubt as to Liability: This means there is sufficient doubt that you actually owe the amount that was assessed. You must be able to prove that this is the case.
  • Effective Tax Administration Offers: This is where there is no question regarding the amount of tax owed and that the liability could be paid, but there are exceptional circumstances that warrant acceptance of an offer.

An Offer in Compromise is an agreement between you and the IRS to pay less than the full amount of taxes owed. If your offer is accepted and you make the offer payments as agreed upon, the remainder of your liability will be forgiven. As a condition of acceptance, you will be required to stay in compliance with your tax filing and payment obligations for a period of time.
